SparkData Terms of Service
1. Service scope
SparkData provides China market-data lookup, organization, and technical interfaces for applications, developers, and agents. Available datasets, update frequency, rate limits, allowed APIs, and denied APIs depend on the applicable page, API response, and plan.
SparkData does not provide securities account opening, order execution, asset custody, asset management, stock recommendations, or investment advice. Data and analysis are for informational and technical use only and are not investment advice or a promise of returns.
2. Accounts and sign-in identities
You may sign up or sign in using an email code, SMS code, or WeChat authorization. Successful verification creates an account automatically when the identity is not yet registered. You must provide valid information and protect your devices, codes, and sessions.
A user may belong to one or more tenants. A tenant is the business boundary for quota, permissions, and API keys; it is not a duplicate user account. You may access only tenants you belong to and resources granted to you.
3. API keys and constraints
- Each tenant may have up to five active API keys. Revoked or expired keys do not count toward the active limit.
- A complete API key is displayed once when created. Save it securely and never expose it, share it with unrelated people, or commit it to a public repository.
- Rate limits, daily quotas, allowed APIs, and denied APIs may inherit from account, tenant, plan, or administrator policy. You must not bypass limits, abuse APIs at scale, or disrupt service stability.
- Revoke a key immediately and contact us if you suspect exposure or misuse. Requests made with credentials you failed to protect are treated as requests from your account.
4. Data accuracy and availability
We use reasonable efforts to keep the service available and source information traceable. Market data may nevertheless be delayed, missing, or inconsistent because of providers, networks, exchange changes, suspensions, adjustment methods, or force majeure. Verify important results against original sources and your own rules.
Maintenance, upgrades, security events, or third-party outages may interrupt service. Important workloads should include caching, retries, fallbacks, and human review and must not rely on SparkData as their sole decision source.
5. Acceptable use
- Do not use the service for unlawful activity, attacks, reverse engineering, unauthorized access, or infringement.
- Do not resell, publicly distribute, or exceed licenses for restricted data. You are responsible for downstream display, storage, and redistribution rights.
- Do not impersonate others or evade quotas and risk controls through multiple accounts, keys, or proxy addresses.
6. Intellectual property and feedback
SparkData software, interfaces, documentation, trademarks, and original content belong to us or their respective owners. These Terms transfer no intellectual property unless expressly stated. You retain existing rights in your business data. We may use voluntary feedback to improve the service without disclosing your confidential information.
7. Suspension, termination, and changes
We may limit, suspend, or terminate service for security risk, unlawful use, non-payment where applicable, resource abuse, or a material breach, with notice when legally permitted and operationally safe. You may stop using the service or request deletion under the account-deletion instructions.
We may update these Terms for product, legal, or security reasons. Material changes will be announced through the website, account notices, or your contact details. Continued use after an update means acceptance of the revised Terms.
8. Liability and disputes
To the extent permitted by law, we are not responsible for investment, trading, or business decisions based on market data. Each party remains responsible for foreseeable direct loss under applicable law; liability that cannot legally be excluded or limited remains unaffected.
These Terms are governed by the laws of the People's Republic of China. The parties should first negotiate in good faith. Unresolved disputes may be brought before a competent court where the operating entity is located.
